The findings of the Court of Marine Enquiry of the hake trawler MFV Lindsay and the liquid fruit juice tanker MV Ouro do Brasil were made public on the first anniversary of the disaster – 8 May 2006.
According to court documents, the MV Oura do Brasil made two alterations of course to starboard, neither of which was substantial in ensuring a safe passing distance with the Lindsay. The Lindsay on the otherhand also made a succession of alterations of course to port putting her in the oncoming path of the Oura do Brasil. Both vessels made no adjustments to speed, nor were sound or light signals used.
