Broad-based black economic empowerment (B-BBEE) legislation is a reality South African white-owned companies – especially smaller entities – are obliged to comply with. It is no secret that presenting the credentials of black employees for the purpose of obtaining a fishing right is a big legal no-no in the commercial fishing industry. Now a Cape Town-based company has been found out to have done just that even though there is no participation or said economic interest for the said black employees.
