Seavuna Fishing Company (Pty) Ltd’s review application was successful. It has effectively set the clock back to December 2016 for new entrant Category B and C right holders in the hake inshore trawl sector. What now?

On 1 August 2019, acting Judge Davis of the Western Cape Division of the High Court granted an Order by agreement which effectively set the clock back to 20 December 2016 with regard to the new entrant Category B and C right holders in the Hake Inshore Trawl (HIT) sector.

This Order was the conclusion of the review application launched by Seavuna Fishing Company (Pty) Ltd (Seavuna) following the previous Minister of Agriculture, Forestry and Fisheries appeal decisions in the HIT sector on 7 December 2018.

Due to previous High Court Judgments reviewing and setting aside the appeal allocations in Category B and C of the HIT sector, the Minister was ordered to reconsider and decide the Category B and C appeals once again.
